PLANT BREEDER'S RIGHTS

FAL has advised at the cutting edge of Plant Breeder’s Rights commercialisation for almost 20 years. We’ve advised on the establishment of some of the most significant, multi-party plant variety research consortia. Through our work with government clients, we have also played a significant role in standardising research agreements across all States in Australia.

Our lawyers have drafted and negotiated licensing agreements for a great number of plant varieties, including wheat, barley, canola, forages and fruit trees of both genetically modified (GM) and non-GM variety.

We can advise you on the following types of matters in respect of PBR:

  • Patent & technology licensing agreements
  • Technology transfer
  • Plant Breeder’s Rights commercialisation
  • In-licensing of patented technology
  • Software licensing agreements
  • Trade mark licensing
