Sean is a lawyer and registered trade marks attorney with over 10 years’ experience in IP and technology commercialisation. He acts for public and private sector organisations including start-ups, SME’s, government, CRCs and large multi-nationals in contentious and transactional matters. Sean has represented some of the world’s leading brands in the biotech, chemical, oil & gas, food & beverage, fashion, luxury goods and animal health industries.
Sean has extensive experience in trade mark clearance, protection and enforcement strategies both locally and internationally. He works closely with local clients to ensure their brands are protected in foreign markets through a strong network of overseas associates, and provides advice which is value driven and risk controlled. Sean regularly initiates and defends trade mark opposition, removal and revocation proceedings in Australia and New Zealand, and represents clients in hearings before the Australian Trade Marks Office. Implementing successful anti-counterfeiting and customs seizure strategies for well-known international and local brands is another key element of his practice.
Sean’s commercial practice includes negotiating, drafting and advising on various agreements relating to IP and technology commercialisation. He also advises on competition and consumer law issues, certification trade marks and franchising. Sean has conducted IP contract drafting workshops to the Association of Corporate Counsel, and presented on licensing and technology transfer to research institutions. Sean also has a proven track record in asserting IP rights and resolving disputes in line with his clients’ business strategy, including trade mark and copyright litigation in the Federal Court of Australia, patent and design litigation in the USA and China, trade mark proceedings in many countries and domain name recovery through the World Intellectual Property Organization.
Prior to joining FAL Lawyers, Sean worked in the Legal/Trade Marks Group of another leading IP practice.
